Terms of Service

These Terms of Service (the "Terms") govern your access to and use of GhostyAds (the "Service"), operated by GhostyAds ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

GhostyAds processes video files you upload and returns modified versions of them. Processing options are selected by you at the time of each job. The Service is provided for lawful use in connection with advertising and marketing activities.

2. Accounts

You must provide accurate information when creating an account and are responsible for keeping your credentials confidential. One account is intended for one customer. You are responsible for all activity that occurs under your account. Notify us at support@ghostyads.com if you believe your account has been compromised.

3. Your content

You retain all ownership of the video files and other material you upload ("Your Content"). You grant us a limited licence to process, store, and transmit Your Content solely to operate the Service for you. We do not sell Your Content and we do not use it to train models.

You represent that you hold the rights necessary to upload and process Your Content, and that doing so does not infringe the rights of any third party or violate any law.

4. Acceptable use

You may not use the Service to process material that is unlawful, that infringes intellectual property or privacy rights, that depicts minors inappropriately, or that is intended to deceive in a way that causes harm. You may not attempt to disrupt the Service, circumvent usage limits, gain unauthorised access to any part of it, or resell access without our written agreement.

We may suspend or terminate accounts that violate this section.

5. Plans, usage and billing

Plans, included minutes, file size limits, concurrency limits and retention periods are described on our pricing page and may change with notice. Paid plans are billed monthly in advance in Brazilian reais.

Usage is measured by the actual duration of each video processed and is recorded at the time of processing. Deleting a video after it has been processed does not restore consumed minutes. Usage allowances reset at the start of each monthly period and do not carry over.

On paid plans, minutes beyond your included allowance are charged at the per-minute rate published for your plan. On the free plan, processing is blocked once the allowance is exhausted.

6. Cancellation and refunds

You may cancel at any time from your account. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then. We do not provide pro-rata refunds for partial periods except where required by law.

7. Retention and deletion

Files are retained for the period associated with your plan and are then removed automatically. You may delete files earlier at any time. Deletion is permanent and we cannot recover deleted files.

8. Availability

We aim to keep the Service available and performing well, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice where practicable.

9. Disclaimer and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We are not responsible for the performance of any advertising campaign, for decisions made by advertising platforms, or for the acceptance or rejection of any material by a third party.

To the maximum extent permitted by law, our total liability arising out of or relating to the Service will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, or for lost profits or lost data.

10. Changes to these Terms

We may update these Terms. If a change is material we will provide notice by email or in the Service. Continuing to use the Service after a change takes effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute will be subject to the courts of Brazil.
